Welcome to paintDJ!
These Terms of Service ("Terms") govern your use of our website and services (collectively, the "Service"), operated by paintDJ ("us", "we", or "our") from Quebec, Canada.
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms.
1. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
2. Subscriptions
Our Service is billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.
Payments: All payments are processed by our third-party payment processor, Stripe. We do not store your credit card details.
Cancellation: You may cancel your subscription at any time. The cancellation will take effect at the end of the current Billing Cycle.
3. User-Generated Content
Our Service allows you to create and store content, including paint collections and color palettes ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. When you upload or otherwise submit User Content to our Service, you give us a worldwide license to use, host, store, reproduce, and display such content for the limited purpose of operating and improving our Service.
4. Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. In no event shall paintDJ, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the Service.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
